Terms of Service
Last updated: September 29, 2026
Agreement
These Terms of Service apply when you use this website, ask Fixmark Group LLC for a quote, send us a work order or receive our text messages. If you have a signed master services agreement or subcontract with us, that agreement controls wherever it conflicts with these terms. Please also read our Privacy Policy.
What we do
We provide commercial facility services in Texas. Our service lines are:
- Handyman & General Maintenance
- Doors & Hardware
- Lighting & Relamping
- Painting & Drywall
- Flooring Repair
- Exterior & Parking Lot
- Janitorial, Day Porter & Windows
- Glass & Board-Up
- Roofing Repairs
- Fixtures, Signage & Assembly
- Fencing & Minor Concrete
Every job is limited to the scope written on the quote or work order.
Scope of work
Our work is limited to the service lines listed above. We do not perform work that requires a state trade credential we do not hold. If a request needs that kind of work, we tell you before any work begins so you can assign a qualified provider. Our lighting service is limited to replacing lamps and tubes in existing fixtures, and our door service does not include locksets, exit devices, cylinders or keys.
Quotes, NTE amounts and approvals
- A quote is an estimate for the scope described. Unless it says otherwise, it is valid for 30 days.
- When a work order carries a not-to-exceed (NTE) amount, we will not bill above it without approval.
- If the job will cost more than the NTE, or we find more work than was ordered, we stop at a safe point, document the reason with photos and ask for written approval before going further. Approval must come through the client’s platform or in writing by email.
- Extra problems we notice are reported as recommendations. We do not fix and bill them without approval.
Scheduling, access and site conditions
You agree to give us safe access to the work area at the scheduled time and to tell us about known hazards, including asbestos, lead paint, mold, energized equipment or restricted areas. We may pause or decline work that we believe is unsafe or needs a city approval that is not yet in place. A missed visit caused by lack of access may be billed as a trip charge if the quote or work order says so.
Invoicing and payment
- We invoice after the work is completed, with the work-order number, a description of the work and closeout photos.
- Payment is due 30 days from the invoice date unless your agreement or platform terms say otherwise.
- Texas sales and use tax is added to taxable services, including nonresidential repair labor and building cleaning, unless you give us a valid resale or exemption certificate.
- Please raise invoice questions within 30 days so we can resolve them quickly. Past-due amounts may accrue interest at the rate allowed by Texas law.
Workmanship warranty
We warrant our labor against defects in workmanship for 90 days after completion, unless the quote states a different period. If a covered problem appears, we will return and correct it at no labor charge. Materials carry only their manufacturer’s warranty, which we pass through to you. The warranty does not cover damage from misuse, accidents, weather, other contractors or normal wear.
Limitation of liability
To the fullest extent Texas law allows: (a) neither party is liable to the other for indirect, incidental, special or consequential damages, including lost profits or lost business; and (b) our total liability arising from any work order is limited to the amount paid for that work order. These limits do not apply to claims caused by gross negligence or willful misconduct, to amounts covered by insurance we are required to carry under a written agreement, or where a signed agreement sets different terms.
Insurance
The insurance limits we carry, and whether each policy is in force or in placement, are listed on our Compliance page. Certificates of insurance are issued within one business day of a request.
